Terms of Service

These Terms of Service ("Terms") govern your use of the PinHigh mobile application ("App") operated by PinHigh ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms.

1. Use of the App

PinHigh is a golf GPS and AI simulation application. You may use the App for lawful, personal, non-commercial purposes unless you have entered into a separate commercial agreement with us (for example, a B2B pilot agreement). You agree not to reverse engineer, decompile, or attempt to extract the source code of the App.

2. Accounts

You must create an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@pinhigh.app if you suspect unauthorized use.

3. Subscriptions and purchases

Subscriptions and one-time purchases made within the iOS app are processed by Apple through the App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in Settings → [your name] → Subscriptions on your iOS device.

B2B pilot contracts (for example, the Virtual Club Champion pilot) are negotiated separately and processed off-device by Stripe under an executed commercial agreement.

4. Refund policy

Refunds for iOS in-app purchases are handled by Apple in accordance with their policies. To request a refund, visit reportaproblem.apple.com. For B2B pilot contracts, refund terms are set out in the applicable commercial agreement.

5. GPS and location

The App uses your device's GPS to provide distance measurements during a round. GPS accuracy depends on device hardware, obstructions, and satellite availability. PinHigh is not responsible for inaccurate GPS readings or decisions made based on in-app yardage data. Always comply with the rules of the course you are playing.

6. AI simulation disclaimer

PinHigh's AI opponent is a statistical simulation calibrated to published amateur and professional golf benchmarks. It is intended for entertainment and practice purposes only. Results are simulated and do not represent any real individual's actual game.

7. Intellectual property

All content, code, algorithms, and design elements of the App are the intellectual property of PinHigh. The AI simulation methodology is the subject of a pending patent application. You may not copy, reproduce, or distribute any part of the App without prior written consent.

8. Disclaimer of warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses. Use of GPS-based features is at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, PinHigh shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination and account deletion

We reserve the right to suspend or terminate your account for violation of these Terms. You may delete your account at any time in Settings → Account → Delete Account or by following the instructions at pinhigh.app/delete-account.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of the App after changes constitutes acceptance.
